1.1. By installing the Application (as defined below), you agree to be bound by these terms of use (“appterms”). Please review them carefully before installation and/or acceptance.
The “Application” shall mean the software provided by Goliath to offer services related to Goliath, Goliath’s services and its partners’ services, to be used on Apple iOS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.
Contact Goliath at the e-mail address info@goliathgames.nl if you have not accepted this agreement and if your child under the age of 13 has become a member of the Application. Goliath urges all parents to be actively involved in following their children’s activity on the internet.
Goliath is committed to protecting your privacy. Authorized employees within Goliath use any information collected from individual customers on a need to know basis only. Goliath constantly reviews its systems and data to ensure the best possible service to its customers. Any personal information you supply to Goliath when using the Application will be used by Goliath in accordance with its Privacy Policy.

5.1. Users are expected to communicate respectfully and refrain from engaging in any form of offensive, abusive, or inappropriate language.
5.2. Sexual content, discussions, or solicitation of explicit material are strictly prohibited.
5.3. Triominos is not a dating platform. Using the game as a dating platform is not tolerated by the game.
6.1. Users are not allowed to solicit phone numbers or communications on other platforms for sexual purposes.
6.2. Requesting or engaging in sexual conversations on the in-game chat is strictly prohibited.
Users must refrain from uploading or sharing images that are explicit, offensive, or violate community standards.
Harassment, bullying, or discriminatory behavior towards any individual or group is not tolerated.
Users are encouraged to report any inappropriate behavior or content through the reporting feature in the Chat screen menu.
10.1. The game administrators have the right to take immediate action, including muting or banning, against users found violating these guidelines without prior notification.
10.2. Users engaging in inappropriate behavior may face temporary or permanent account suspension.
Triominos aims to provide a community atmosphere suitable for players of diverse backgrounds. All users are expected to contribute to a positive and inclusive gaming environment.
Users are encouraged to contribute positively to the community, fostering a friendly and inclusive gaming environment.
13.1. In order to access certain aspects of the Application, you must allow Goliath to access your Facebook account using Facebook’s “Facebook Connect” authorization procedure. By authorizing Goliath to access your Facebook account, you hereby grant Goliath access to certain information in your Facebook profile, including but not limited to: name and surname, e-mail address, profile picture, friends and name and surname and profile picture of friends.
13.2. By authorizing Goliath to access your Facebook account, you hereby allow Goliath to display your name and surname and profile picture to other users of the Application.
The Application allows you to access certain functionality available on the goliathgames.com and triominos.com website. Such access will be governed by the Goliath Website Terms of Use.
All trademarks, copyright, database rights and other intellectual property rights of any nature in the Application together with the underlying software code are owned either directly by Goliath or by Goliath’s licensors.
16.1. You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.
16.2. The Application is currently made available to you free of charge for your personal, non-commercial use. Goliath reserves the right to amend or withdraw the Application, or charge for the application or service provided to you in accordance with these appterms, at any time and for any reason.
16.3. You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using the Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Application or any such third party charges as may arise. You accept responsibility for any such charges that arise.
16.4. If you are not the bill payer for the mobile telephone or handheld device being used to access the Application, you will be assumed to have received permission from the bill payer for using the Application.
16.5. You will not, nor allow third parties on your behalf to publish violent, discriminatory, unlawful, infringing, hateful, pornographic or sexually explicit images or other content via use of the Application.
17.1. This Application is available to handheld mobile devices running Apple iOS Operating Systems. Goliath will use reasonable efforts to make the Application available at all times. However you acknowledge the Application is provided over the internet and mobile networks and so the quality and availability of the Application may be affected by factors outside Goliath’s reasonable control.
17.2. Goliath, its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of the Application, or any difficulty or inability to download or access content or any other communication system failure which may result in the Application being unavailable.
17.3. Goliath will not be responsible for any support or maintenance for the Application.
18.1. In order to use the Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications (‘Software Requirements’).
18.2. The Software Requirements are as follows: Apple iOS devices running iOS6 or later versions; Language: Dutch, English, French, German, Spanish, Portuguese, Polish.
18.3. The version of the Application software may be upgraded from time to time to add support for new functions and services.
19.1. Goliath may terminate use of the Application at any time.
19.2. Upon any termination,
(a) the rights and licenses granted to you herein shall terminate;
(b) you must cease all use of the Software;
20.1. To delete your account, go to "Advanced Settings" and select the deletion option.
20.2. Your username will not be available for reuse.
20.3. Game history cannot be deleted to preserve the experience of other players.
20.4. Account information will be erased from our databases within one month.
21.1. In no event will Goliath be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to the Application, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
21.2. Goliath is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the Application.
21.3. Nothing in these appterms shall exclude or limit Goliath’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
To the maximum extent permitted by law, and for the avoidance of doubt, Goliath hereby disclaims all implied warranties with regard to the Application. The Application and software are provided “as is” and “as available” without warranty of any kind.
